If you find yourself in Spain as a tourist and are considering regularizing your situation without leaving the country, it is important to know that not all permits can be applied for from Spain or at any time. Each authorization has its own legal regime and, above all, different deadlines. Confusing them is one of the most common mistakes and one of the main causes of denial.

In this article, we explain in a clear and up-to-date way what permits can be requested from Spain while being a tourist, at what time and with what nuances.

1. Being in Spain as a tourist: the starting point

Entering Spain as a tourist implies being in a situation of stay, not of residence.

This means:

  • A maximum stay of 90 days.
  • General prohibition on working.
  • Clear limitations on changing immigration status.

General rule: residence permits are requested from the country of origin. Exception: Only those explicitly authorized cases allow the application to be submitted from Spain.

2. Permits that can be requested from Spain

2.1. Digital nomad: before 3 months have passed

The residence permit for teleworkers of an international (digital nomad) nature can be applied for from Spain, but only as long as the person is in a legal status of stay.

In practice:

  • It must be submitted before 90 days have passed since entry.
  • It is essential to have entered Spain legally.
  • Once the tourist period has ended, this route is no longer viable from Spain.

It is one of the most solid options, but very dependent on timing.

2.2. Student visa: before 60 days have passed


The student visa has an even stricter deadline when applied for from Spain.

For it to be viable:

  • The applicant must be legally present in Spain.

The application must be submitted:

  • before 60 days have passed since the date of entry, and
  • when there are still at least 30 days of legal stay remaining.
  • It must be submitted before the start of studies.
  • The training must be official or recognized and the center must be authorized.

It is a legal route, but very sensitive to the calendar.

2.3. Family member of a citizen of the European Union: even after


If you are a family member of a European Union citizen, you can apply for the EU citizen family member card directly from Spain.

In this case:

  • Entry as a tourist is valid.
  • It is not essential to submit the application within 90 days.
  • It can be requested even after the tourist stay period has ended.
  • Here, the right to free movement and family life takes precedence.

2.4. Family member of a Spanish citizen: even outside the tourist period


With the reform of the Foreigners’ Regulations, a specific temporary residence authorization was created for the family members of Spanish citizens, which initially seemed to require an application from abroad using a visa. However, the current criteria are those set out in SEM 2/2025 Instructions, which have clarified the procedure.

As of today:

  • The application can be submitted directly from Spain.
  • It is not mandatory to apply for a visa at the consulate.
  • Entry as a tourist is valid.
  • It can occur even after the tourist stay period has ended.

This permit applies, among others, to: Spouse or partner of a same-sex couple.

  • Mother and father.
  • Mother-in-law and father-in-law.
  • Children and stepchildren:
  • Minors under 18 years of age,
  • Between 18 and 26 years old,
  • People over 26 years old.

The Administration will continue to check:

  • That the entry was regular.
  • That the family connection is documented.
  • That there is no fraud of the law.

It is one of the most flexible avenues in terms of deadlines, but it requires rigorous preparation of the file.

3. Permits that cannot be requested from Spain as a tourist

In general, they cannot apply from Spain:

  • Ordinary work visa for an external employer.
  • Traditional self-employed permits outside the Startups Act.
  • Other national visas that require consular processing.

Forcing these routes from Spain usually ends in avoidable denials.

4. Clear summary of deadlines

  • Digital nomad → before 90 days have passed.
  • Studies → before completing 60 days (and with at least 30 days remaining).
  • Family member of an EU citizen → can be applied for even later.
  • Family member of a Spanish citizen → can be requested even outside the tourist period.
